Imagin8 is an AI-powered image generation platform that allows users to create images based on text prompts. The Service uses artificial intelligence and machine learning technologies to generate visual content.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or our Acceptable Use Policy.

4. Acceptable Use Policy

You agree NOT to use the Service to generate, create, or share:

• Child Sexual Abuse Material (CSAM) or any content involving minors in sexual or suggestive contexts
• Pornography, sexually explicit, or adult content
• Non-consensual intimate imagery or deepfakes
• Illegal drugs, drug paraphernalia, or drug-related content
• Violence, gore, or graphic violent content
• Content promoting terrorism, extremism, or hate speech
• Harassment, bullying, or threats against individuals
• Illegal activities or content that violates laws
• Impersonation or identity theft
• Copyright infringement or unauthorized use of others' intellectual property

Violations will result in immediate account termination and may be reported to law enforcement.

5. Intellectual Property Rights

5.1 Service Ownership

The Service, including all software, algorithms, and underlying technology, is owned by Imagin8 and protected by intellectual property laws.

5.2 Generated Content

You retain ownership of images you generate using the Service, subject to:

• Compliance with these Terms and our Acceptable Use Policy
• Our right to review and moderate content
• Our right to remove or retain content that violates policies
• Restrictions on commercial use depending on your subscription plan

5.3 User Responsibility

You are solely responsible for ensuring your generated content does not infringe on third-party intellectual property rights.

6. Payments and Subscriptions

6.1 Pricing

Certain features of the Service require payment. Prices are subject to change with notice.

6.2 Subscriptions

• Subscriptions automatically renew unless cancelled before the renewal date
• Refunds are provided according to the platform's refund policy
• No refunds for partial subscription periods

iOS Users: Subscriptions are managed through your Apple ID. To cancel, go to Settings → [Your Name] → Subscriptions and select Imagin8.

Android Users: Subscriptions are managed through Google Play. To cancel, go to Google Play → Subscriptions and select Imagin8.

6.3 Free Trial

If we offer a free trial, you may be charged when the trial ends unless you cancel before the trial period expires.

6.4 Credits (Consumable Purchases)

Credits are consumable items used to generate images. Once used, credits cannot be restored or refunded. Credits do not expire.

7. Content Moderation

We employ automated and manual content moderation to enforce our policies:

• All prompts and generated images are subject to review
• We may retain flagged content for investigation
• Violations may be reported to authorities
• We cooperate with law enforcement investigations

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• We are not responsible for the accuracy or quality of generated images
• Our total liability shall not exceed the amount you paid in the last 12 months

9. Indemnification

You agree to indemnify and hold Imagin8 harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your infringement of any third-party rights
• Content you generate or share

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending an email notification (for significant changes)

Your continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Termination

Either party may terminate this agreement at any time:

• You can delete your account through the app
• We can terminate for violations of these Terms
• Upon termination, your access will be immediately revoked
• We may retain data as described in our Privacy Policy

12. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved in the appropriate courts.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
